Your Tenancy

If your first Wandle tenancy started before 15 January 1989, you’re likely to be a secure tenant protected under the Rent Act 1977 (as amended by the Housing Act 1980).

If your first Wandle tenancy started after that date you’re likely to be an assured tenant under the Housing Act 1988.

If you have a secure or assured tenancy you can stay in your home for as long as you want, provided you don’t breach your tenancy agreement.

You can only be evicted from your home by a court order. And if you die your tenancy can normally be taken over by family member who has been living in the property for the last 12 months.

Your tenancy rights

All residents have full security when it comes to their tenure. You can stay in your home as long as you wish as long as you don’t break your tenancy agreement. Common ways of doing this include not paying your rent, subjecting others to nuisance or antisocial behaviour, damaging your property or telling lies to get your tenancy.

You can only be evicted from your home if the court issues an Order for Possession – and that can only be granted on specific grounds.

Exchanging your tenancy

You can exchange your home with another social housing resident if both landlords agree and you meet certain conditions. Please see our section on Homeswap for more information.
